1. Contest
Description
Robert Mondavi Private Selection Annual Art of the Skewer Recipe Contest is a contest in which you may submit your favorite “Skewer” recipe that fits in with the “Flavors of the Caribbean” theme. Contest is sponsored by Robert Mondavi, Lodi, CA. (“Sponsor”). Recipe entries may be submitted online, or on a single sheet in typewritten format. The entry must include entrant’s name, age, address, telephone number, and e-mail address, if any. Recipe submissions must be the original creation of the entrant and previously unpublished. Recipe Requirements: (1) Ingredients to be listed in order of preparation using standard American measurements and should not exceed 15 ingredients. Salt, pepper, water, skewers, and oil do not count toward the ingredients limit. (2) Ingredients must be readily available in U.S. grocery stores. (3) Preparation time not to exceed one hour. (4) Recipes to include serving size or yield. (5) Recipes must be typewritten for mail-in submissions. (6) Recipe must include a wine pairing from Robert Mondavi Private Selection Wine.
2. How to Enter
Two ways to enter: (1) To enter via mail, submit your typewritten recipe on an 8 1/2 x 11 plain piece of paper, along with your name, age, address, city, state, ZIP code, and daytime phone to: Robert Mondavi Private Selection Annual Art of the Skewer Recipe Contest, C/O The Sweepstakes Center, P.O. Box 16379, Rochester, NY 14616. Only one entry per person and per household. All
mail entries must be postmarked by 9/1/06 and received by 9/15/06. (2) To enter via the web go to www.artoftheskewer.com. All e-mail entries must be submitted by midnight on 9/1/06. Sponsor is not responsible for any computer or e-mail failures that may result in lost or garbled entries or which affect the administration of the contest. All entries become the property of the Sponsor and will not be acknowledged or returned. Sponsor and its agents are not responsible for incorrect, lost, late, misdirected, damaged, incomplete, illegible, or postage-due entries, computer system or phone line errors, software/hardware malfunctions, or other errors, failures, or delays in transmission that are human, mechanical, or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading or entering any part of this contest. Sponsor reserves the right at its sole discretion to cancel or suspend this contest should a computer virus, bug, or other cause beyond the control of Sponsor corrupt the administration or proper conduct of the contest. Any online entries submitted, and mailed in entries received, up to the time of cancellation or suspension will be considered in the recipe judging. Online entries will be deemed to have been submitted by the Authorized Account Holder of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (such as a business or educational institution) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute over the entitlement to a prize, the Authorized Account Holder of the designated e-mail address will be considered the winner. This contest is governed by California law. By entering, participating or accepting any prize in this contest, you agree that California courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this contest and that venue shall be only in San Francisco, California. California and Utah residents are not eligible due to state law. Tennessee residents not eligible to enter via internet. This contest is also not available in other jurisdiction in which it, or any aspect of it, is prohibited or taxable to Sponsor.
3. Winner Selection
Judging will be done by Chefs USA, an independent judging agency. Judging will be based on adherence to the Flavors of the Caribbean theme (40%), creativity (30%), and originality (30%). Once submitted, all entries and the good will associated therewith become the sole property of the Sponsor. Winners will be notified on or about November 15, 2006. Judges will disqualify previously published recipes, such as those in cookbooks, in magazines, from food companies, and recipes created by winners of national contests. The winner will be required to certify, that his or her recipe has not been published or publicized and has not won a national contest, is the original unpublished creation of the winner, and that the winner is not a culinary professional such as a chef, home economist, or anyone who has received career/professional/graduate culinary training or who develops/creates recipes and/or food products for profit. Except where prohibited, acceptance of prize constitutes winner’s consent to use of his/her name, likeness, and biographical data for advertising and promotional purposes without additional compensation.
4. Prizes
One (1) Grand Prize will be awarded. Winner
will receive a 7-day 6-night trip for two to the Caribbean including roundtrip
coach airfare for two people from any major U.S. airport, transfers to
and from airport/hotel, and (6) night double-occupancy hotel accommodations
including meals at hotel. Travel subject to space and departure availability.
All taxes, fees, and surcharges on prizes are the sole responsibility of
each prize winner. Gratuities not included. Trip must be taken between
January 1, 2007 and October 31, 2007 or prize will be forfeited in its
entirety and certain blackout dates may apply. (Approximate Retail Value-ARV
$10,000). One (1) First Prize to be awarded. Winner will receive a grill,
metal skewers, BBQ tool set, and a $200 gift certificate to create their
own “Skewer
Party.” (ARV
$750) Twenty-five (25) Second Prizes to be awarded. Winners will receive
an Art of the Skewer Cookbook (ARV $20 each). Total retail value of all
prizes is $11,250. Any other expenses not expressly set forth above are
the sole responsibility of the winner. Sponsor reserves the right, at its
own discretion, to substitute a prize of equal or greater value, if the
particular prize described above is not available or violates applicable
law or regulation.
5. Eligibility
This contest is open to residents of the United States (except UT & CA and elsewhere if taxed or prohibited by law) who are at least 21 years of age except the following: Employees of Sponsor, their families and Sponsors affiliates, printers, advertising and promotion agencies, liquor and wine wholesalers, and retailers and employees of any federal or state liquor authority. Also, culinary professionals such as chefs, home economists, or anyone who has received career/professional/graduate culinary training or who develops/creates recipes and/or food products for profit are not eligible to enter. All federal, state, and local laws and regulations apply. Odds of winning depend upon the number of entries received. Estimated non-internet circulation is 500,000. Except where prohibited, acceptance of prize constitutes winner’s consent to use of his/her name, likeness, and biographical data for advertising and promotional purposes without additional compensation.
6. General:
Grand prize winner will be required to sign an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release and return within 14 days of attempted delivery or an alternative winner may be selected. Travel companion must sign a Liability/Publicity Release prior to travel. Entrants agree to abide by the terms of these Official Contest Rules and by the decisions of the judges, which are final on all matters pertaining to this Contest. All federal, state, and local laws apply. All federal, state, and local taxes on the prize are winner’s sole responsibility. All entries, including the winning recipe, become the sole and exclusive property of Sponsor and its affiliated companies upon the submission of the recipe entry to this competition. By entering the competition, the entrant represents and warrants to Sponsor that he or she is the sole creator of the recipe; that he or she is fully empowered to transfer and assign and, by entering, does transfer and assign, all right, title and interest in and to the recipe and the good-will associated therewith worldwide and in perpetuity, including copyright and all other intellectual property rights to Sponsor, its successors, and assigns. Submission of a recipe grants Sponsor the right to use, publish, adapt, edit and/or modify such recipe in any way, in any and all media worldwide, without limitation, and without additional compensation to the entrant. Entries must be the original work of the entrants; must not have been submitted to another contest, promotional event, or for publication; must not have won previous prizes; must not have been published previously; must not be obscene or indecent (in the opinion of the judge); and must not infringe any third-party rights. Prize is not transferable or redeemable for cash. Entering contest constitutes agreement to these rules. By entering, participating, or accepting any prize, you agree that Sponsor and/or its independent judging agency has the sole right to decide all matters and disputes arising from this contest. By participating, entrants agree to be bound by these Official Rules and that all decisions of Sponsor on all matters relating to this contest are final. Winners release Sponsor, its directors, officers, employees, and agents from any and all claims, liability, loss, or damage, including any third-party claims, arising from or relating to, in whole or in part, this contest, including entry and participation in this contest and acceptance, possession, use or misuse of a prize, or while preparing for participating in and/or traveling to or from any prize-related activity. Entrant agrees that if any third party makes a claim for breach of copyright or any loss or damage arising from entrant’s submission to the contest, entrant will indemnify Sponsor, its directors, officers, employees, and agents from any and all such claims, including reasonable attorneys’ fees related thereto.
